A fair, misuse-resistant leave policy balances clear entitlements with simple rules and consistent enforcement. Start from the statutory minimums for your state, define each leave type and its purpose, set transparent rules for application, approval, notice, and carry-forward, and apply them uniformly so the policy is seen as fair.

To discourage misuse without being punitive: require advance application for planned leave with reasonable notice; ask for documentation only where genuinely warranted (such as extended sick leave); track patterns rather than policing individual days; and give managers consistent guidance so approvals don’t vary arbitrarily between teams. A policy that is clear, predictable, and evenly applied prevents far more misuse than one built on restrictions, because most misuse thrives in ambiguity.
